SUMMARY OF THE TERMS OF USE
TIM is a system provided by the University of Jyväskylä for the production and publication of interactive materials. You can log in to TIM with your Haka credentials or by creating a separate TIM account. The username must be in accordance with good manners. The username and password are personal and may not be disclosed to third parties.
It is possible to store data on TIM’s server. Although TIM maintenance makes every effort to preserve the data, complete assurance cannot be guaranteed. It is recommended that you make your own backup of important data.
The user is responsible for all content that is uploaded to TIM. No illegal or offensive material or adult content may be uploaded to the system. If illegal content or content that violates the terms of use is detected on the TIM website, the administrators must be notified. TIM can be contacted in Finnish or English.
TIM’s terms of use are subject to change as necessary. Users will be notified of any changes to the terms of use.
TIM maintenance strives to keep the system running continuously, but unexpected disruptions may occur. The system is constantly being developed, and therefore its content and functionality may change. In the absence of funding or personnel, the operation of the system may cease completely.
Violation of the terms of use may result in the deletion of the uploaded content or user account. Unused accounts can also be deleted. In case of problems or disputes, you can contact the administrators. If the matter is not resolved, it can be taken to the District Court of Central Finland for a decision.
TERMS OF USE
1. SERVICE CONTENTS AND TERMS OF USE
The TIM System (referred to as “System”) administrated by the University of Jyväskylä (referred to as “Service Provider”) is a document-based cloud service for producing interactive materials. The System is primarily intended for use by educational institutions and individual students and teachers, but it can also be used by others.
These Terms of Use are applied for the use of this System. The Terms of Use regulate the relationship between the Service Provider and the System Users (referred to as “Users”). The rights of this System are owned by the Service Provider and the Users are granted the right to use this System according to these Terms of Use.
By registering to the System or by using it the User approves these Terms of Use and agrees to comply with them. If the User does not approve these Terms of Use, the User cannot use the System. The Users are also obliged to comply with the Finnish law, other applicable regulations and to follow good practice.
2. DATA PROTECTION
The Service Provider will comply with the Finnish law in the processing of personal data. Detailed information on the processing of personal data can be found in the Privacy Notice, which the User registering to the System shall read.
The System can also be offered as a publishing platform for the Users. Use as a publishing platform may also include the processing of personal data. In such cases, the data controller using the System decides what personal data it collects through the System, is responsible for the lawfulness of its processing of personal data and informs data subjects about the processing. The User using the System as a publishing platform or the User’s background organisation must enter into a Data Processing Agreement with the Service Provider.
3. REGISTRATION AND USERNAME
The System can be used with both Haka Account and a separate TIM Account. Haka Account should be used primarily. When creating a separate TIM Account, the User must provide the identification information required in the registration form. The Username cannot include expressions that are offensive or encourage to take part in criminal activities. The Username must comply with the Terms of Use and good manners. When registering for the System and when using it, the User must provide truthful information.
The Users are responsible for their actions performed with their User Account. The Username and Password of the User Account are personal, and they must not be given to third parties. If the Password or Username of the User Account are discovered by third parties, the User must immediately notify the Service Provider.
4. STORING OF INFORMATION AND BACKUP
The User may store material on the Service Provider’s server. However, the Service Provider does not guarantee the preservation of the stored data and is not liable for any damage caused by alteration, loss, destruction or deletion of the data. To preserve the data, the User is responsible for making back-up copies of the data and material stored on the Service Provider’s server.
5. RESPONSIBILITY OF USING THE SERVICE AND USER CONTENT
The User is responsible for all the material they save in the System and/or provide for other Users of the System to be available (e.g. by uploading material into the System, by using different linking methods, and other possible ways). The Service Provider does not actively go through the material the Users are providing for the System and therefore is not responsible for the contents of the material. The following material cannot be provided or saved in the System:
- Material violating third parties’ copyrights or other rights.
- Material violating, degrading, harassing, or threatening someone.
- Material interfering with the functioning of the System.
- Material containing adult entertainment or sexually explicit nudity.
- Material that is otherwise contrary to Finnish law or good manners.
Using the System for commercial purposes must be agreed separately with the Service Provider.
A User who notices that there has been material added to the System that is against these Terms of Use or a User who observes behaviour that violates these Terms of Use is required to notify the Service Provider immediately.
6. RIGHTS OF USER CONTENT
These Terms of Use do not affect the ownership of the material provided to the System. The property rights remain with their original authors. Based on these terms of use the Service Provider does not have any other rights for the provided material, except for the rights they need to carry out the System according to these Terms of Use.
An example: A photo uploaded to the System is shared either in its original form or in an edited form to other Service Users with pre-determined publicity settings. The different versions of the photo can, if necessary, be prepared and shared through third parties’ proxy servers to improve performance.
Furthermore, the Service Provider may use their rights described in Section 11. These include, for example, removing the material violating these Terms of Use from the Service.
7. CHANGING THE TERMS OF USE
The Service Provider has a unilateral right to change these Terms of Use at any point. The changes are notified in a manner considered appropriate. The User accepts the changed Terms of Use by using the System after being informed about the changes.
8. ADMINISTRATION AND UPDATES OF THE SERVICE
The Service Provider aims to produce as reliable a System as possible. By default, the System is usable 24 hours a day. However, the Service Provider does not guarantee the functionality or features of the System.
The Service Provider aims to constantly develop the System and this is why there might be changes made to the System. The User understands and approves that the developments, changes, a partial or complete shutdown of the System, and the decisions related to these are made unilaterally by the Service Provider.
9. SERVICE BREAKS
The Service Provider is not responsible for the damage caused by technical issues, maintenance work, updates, interruptions in telecommunications network or internet connections, or other possible issues resulting in service breaks.
10. NOTIFYING OF MATERIAL AGAINST THE TERMS OF USE OR LAW
Users have the option to notify to the Service Provider any material found in the System that violates the Terms of Use or the Law. If the person making the notification has provided their electronic contact details, the Provider will send an acknowledgement of receipt of the notification using these contact details.
The Service Provider will process the notifications received without delay. The notification is always assessed by a natural person. In cases of ambiguity, the Service Provider may request further information from the notifier before finally deciding on the matter.
The Service Provider may refuse to handle repeated and manifestly unfounded notifications from the same Party.
11. CONSEQUENCES FOR BEHAVIOUR VIOLATING THE TERMS OF USE OR LAW
The Service Provider has the right to remove from the System or block any material distributed using the System that, in the Service Provider’s judgement, violates the rules and policies set forth in these Terms of Use or is unlawful. In addition, the Service Provider has the right to delete the User Account of the System User for a limited period or, in serious cases, permanently. The Service Provider cannot delete the User Accounts of the System Users using HAKA Accounts but can prevent their use when logging into the System. Hereinafter, deleting a User Account also refers to blocking logins with HAKA Account.
A User Account is deleted permanently if:
- The User has a clear intent to use the System in a manner inconsistent with its intended use, materially violates the Terms of Use or submits material that is patently unlawful; or
- The User repeatedly commits minor violations of the Terms of Use.
After assessing the suspected violation, the Service Provider will take any action it deems necessary. In cases open to interpretation, The Service Provider shall justify its decision and deliver it electronically to the subject of the restriction decision. In obvious cases reasoning of the restriction decision is only available upon request. If the decision is based on a notification received by the Service Provider, the Service Provider may also forward the decision to the notifier if being informed is necessary considering the notifier´s own rights.
12. REMOVING THE USER ACCOUNT FOR OTHER REASONS THAN VIOLATING THE TERMS OF USE
In addition to section 11, the Service Provider has the right to remove the TIM User Account if the following conditions are met:
- The User has not logged in / used their User Account in 12 months;
- The User has been notified of this by sending an email to the email address the User has provided and the User has been requested to respond the message accordingly; and
- The User does not respond the message within 90 days.
13. APPLICABLE LAW AND DISPUTE RESOLUTION
Finnish law shall be applied to these Terms of Use. Disputes arising from these Terms of Use shall be resolved primary through mutual negotiations. If a settlement cannot be reached through mutual negotiations, the dispute shall be submitted to the District Court of Central Finland.
